{"id":695,"date":"2022-02-05T00:21:02","date_gmt":"2022-02-05T00:21:02","guid":{"rendered":"http:\/\/rfch.bvs.hn\/?p=695"},"modified":"2024-10-22T16:56:38","modified_gmt":"2024-10-22T16:56:38","slug":"el-peritaje-forense-en-los-casos-de-violacion-en-honduras-previo-a-la-independencia","status":"publish","type":"post","link":"https:\/\/rfch.bvs.hn\/?p=695","title":{"rendered":"El peritaje forense en los casos de violaci\u00f3n en Honduras previo a la independencia"},"content":{"rendered":"\n<p><strong>Justificaci\u00f3n:<\/strong> la bibliograf\u00eda sobre delitos sexuales en el periodo de dominaci\u00f3n hisp\u00e1nica en Am\u00e9rica (1492-1821) es escasa, existiendo importantes vac\u00edos historiogr\u00e1ficos que dificultan la reconstrucci\u00f3n de un panorama general del proceso penal conducido en esa \u00e9poca, por lo que, investigar el peritaje conducido en los casos de violaci\u00f3n es un primer paso para rastrear la evoluci\u00f3n del tratamiento de esos casos en las instituciones judiciales.<\/p>\n\n\n\n<p><strong>Objetivo: <\/strong>describir c\u00f3mo se ejecutaba el peritaje forense en los casos de violaci\u00f3n sucedidos en la Honduras previo a su independencia pol\u00edtica de Espa\u00f1a.<\/p>\n\n\n\n<p><strong>Metodolog\u00eda: <\/strong>se adopt\u00f3 un enfoque cualitativo con un dise\u00f1o exploratorio, utiliz\u00e1ndose fuentes primarias que fueron seleccionadas mediante muestreo no probabil\u00edstico.<\/p>\n\n\n\n<p><strong>Resultados:<\/strong> se logr\u00f3 identificar dos casos en los cuales se hizo recurso de peritos para confirmar una violaci\u00f3n. En ambos las expertas ten\u00edan el oficio de partera, brindando declaraciones que reflejan una falta de preparaci\u00f3n profesional y un conocimiento basado en la experiencia. Las declaraciones fueron transcritas conserv\u00e1ndose la ortograf\u00eda de la \u00e9poca y comentadas para ubicarlas en su contexto.<\/p>\n\n\n\n<p>C<strong>onclusi\u00f3n: <\/strong>en la Honduras de los a\u00f1os previos a la independencia se realizaba un peritaje forense en casos de violaci\u00f3n basado en la experiencia laboral de los peritos y no en informaci\u00f3n cient\u00edfica o preparaci\u00f3n acad\u00e9mica, esto condujo a que los juicios de los expertos se vieran afectados por sus sesgos culturales.<\/p>\n\n\n\n<div class=\"wp-block-buttons is-layout-flex
